In consideration of being allowed to attend The Children’s TherAplay Foundation, Inc.’s annual Hoe Down and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS The Children’s TherAplay Foundation, Inc., and their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

The Children's TherAplay Hoe-Down event is hosted by and for the benefit of The Children's TherAplay Foundation, Inc. (“Children's TherAplay").

No refund of tickets will be made under any circumstances.

Ticket constitutes a license to attend event, which may be revoked at any time for any reason.

This will be an adults-only event. Only persons twenty-one (21) years of age or older may attend.

Children's TherAplay, in its sole discretion, reserves the right to refuse admission or to remove any attendee whose conduct is or becomes disorderly or inappropriate.

The event may be postponed, cancelled, interrupted or stopped due to adverse weather, dangerous situations or any other cause beyond Children's TherAplay's control.

Ticket holders agree to submit to any search for prohibited items including but not limited to weapons and controlled, dangerous and illegal substances.

Ticket holders, for themselves and for any guests accompanying them, voluntarily assume all risk and danger incidental to the event, whether occurring before, during or after the event, including death, personal injury, property loss or damage.

Photography, audio and video recording will be permitted during the event and ticket holders, for themselves and for any guests accompanying them, hereby release Children's TherAplay from any and all liability arising from the taking or publication of any such photograph or recording.

Any resulting photographic, audio or video recordings may be used for by Chidren's TherAplay for promotional purposes without any requirement for permission or compensation.

Any complaints regarding the event shall be directed to and addressed by Children's TherAplay.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ATTENDING THE EVENT, AND ATTEND THE EVENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
